All Rape & Kidnapping Charges Against Decapitated Have Been Dropped (Updated)


Update #2 – January 05th, 2018 – 01:04pm:

Decapitated have now issued a statement regarding the charges against them being dropped:

“All charges against Decapitated have formally been dropped. Arrested September 8 in Santa Ana whilst on tour, the members of the band were jailed until December where they were released on their own recognizance.

New evidence arose that helped show that the band was innocent. While a trial would have given the band the opportunity to have all this evidence heard, the band welcome the decision and are excited to return back to their homes in Poland.

The members of DecapitatedWaclaw, Rafal, Michal and Hubert – send a sincere and heartfelt thanks to all who supported them during this difficult time, including fans, friends, and family.”

Update – January 05th, 2018 – 12:26pm:

While the charges against the band have been dropped, a newly filed report at The Spokesman-Review has word that their dismissal without prejudice (for the well being of the alleged victim) means the band may yet face prosecution in the future. The group were formally charged this past October for an alleged incident back on August 31st in Spokane, WA in which they were alleged to have gang raped a female fan on their bus after their show that night in the city.

The band denied the charges and have been out on bail since last month. The case was to go to trial on January 16th. Interestingly, the report makes mention of the defense attorney’s potential strategy had the case gone to trial. According to the defense, the accuser was shown to have lied to the police about injuries she sustained in the past from a previous spouse. The report states of that:

“In 2014, she admitted to lying to police about injuries she sustained during an assault, when her boyfriend was accused of stabbing three people. She instead was injured by her boyfriend during a previous argument.”

With the charges dismissed, the band will soon be free to return home to Poland.

An initial report from The Spokesman-Review court reporter Jonathan Glover has word that all rape and kidnapping charges made against Decapitated have been dropped over concerns of the well-being of the alleged victim. The case was originally set to go to trial this month. Further details are expected soon.
