Sexual Assault Lawsuit Against Mötley Crüe's Tommy Lee Revived Under New Californian Law

Mötley Crüe drummer Tommy Lee has once again found himself the defendant in a newly refiled sexual assault lawsuit leveled against him by Heather Taylor. Originally filing as a Jane Doe back in 2023, Taylor claimed that she was ‘lured’ onto a sightseeing helicopter flight by late pilot David Martz back in 2003. Taylor alleged that Martz did not inform her Lee was also to be a passenger on the flight, and that Lee and Martz engaged in alcohol, weed and cocaine amid the aforementioned flight.

She also alleged that Lee began, “forcibly groping, kissing and penetrating her with his fingers, and attempting to force her to perform oral copulation” on him during the flight. Amid several issues over how the suit was filed, including statute of limitations concerns and its eligibility to be filed under the Sexual Abuse and Cover Up Accountability Act, the suit was dismissed in 2024.

However, with the recent passing of AB 250 in California — where the incident is alleged to have taken place — Taylor has since revived her lawsuit against Lee. In it she lodges claims of sexual battery, gender violence, intentional infliction of emotional distress, and negligence against Lee. Rolling Stone got word from Taylor and her legal representation for this refiling and they report that she’s seeking unspecified compensatory and punitive damages, while also demanding a jury trial.

AB 250 allows for a temporary January 01st, 2026 to December 31st, 2027 window of revival that enables adult survivors of sexual assault to file civil lawsuits that were previously barred due to statute of limitations issues.
