A report running over at Blabbermouth.net has word that Machine Head are seeking to have former bassist Adam Duce‘s lawsuit against them dismissed. Earlier this year it was revealed that Duce had filed suit for: “damages and punitive damages for trademark infringement, breach of fiduciary duty, breach of partnership agreement, intentional and negligent interference with prospective economic relations, negligence, defamation and unfair competition.” He also wanted the band enjoined from using the Machine Head marks.
The band have of course disputed the claims in detail—read the above-mentioned report for the legalese—and a hearing on Machine Head‘s motion to have Duce‘s lawsuit dismissed will held June 05th in San Francisco, CA.
