Thrash metal legends Megadeth have newly found themselves the defendant in a lawsuit. Artist Brent Elliott White has chosen to pursue legal action against the band, alleging they have yet to pay/credit him for various artwork he has provided for the band since being contacted by them in early 2020.
According to the The Hollywood Reporter, White provided the cover art for the band’s latest album, “The Sick, The Dying… And The Dead!“, and also came up with additional artwork for the band’s stage production. However, according to White, he was contributing the artwork upon the understanding that compensation and a contract were in the works and would be finalized ahead of the album’s released.
He claims that he alerted the band’s management prior to the reveal of any new music from the outing that he was still awaiting the contract/compensation for his artwork. He claims he was assured by management it would be sorted soon. By the time the album itself was released last September, White claims that an agreement for use of his artwork had still yet to be reached.
Per his complaint, White is thus suing Megadeth and UMG for copyright infringement under New York’s Freelance Isn’t Free Act. He is further seeking the court to impose an injunction against the band from using his artwork and seeking damages and disgorgement of profits already generated from usage of his artwork.
