Foo Fighters Drummer Ilan Rubin Faces New Accusations In Cross-Complaint Filed Amid Q Drum Co. Legal Battle

Ilan Rubin (Foo Fighters, ex-Nine Inch Nails) has found himself named in a new cross-complaint regarding his involvement as a co-founder in the drum manufacturing company Q Drum Co. Radaronline.com report that a dispute over the dealings of that company has been playing out in the courts since December 2024.

Tensions arose when the company’s co-founder Jeremy Berman passed away from stage 4 stomach cancer back in January of 2023. It was then that issues began with Berman‘s significant other Brandi Booth, who was named as the executor and sole beneficiary of Berman‘s estate, awarding her a 51% interest in the drum manufacturer. In 2024, Rubin and his business associates filed suit against Booth, alleging fraud, conversion, unfair competition, and more.

Rubin and co. are said to have alleged that Booth terminated the original company and formed another entity utilizing the Q Drum name. Rubin is in part seeking reinstatement of the original company. In Booth‘s new cross-complaint, she has accused Rubin and co. of breach of fiduciary duty, breach of contract, unjust enrichment, fraud and civil conspiracy.

According to Radar, Booth claims that Rubin didn’t recognize her authority in the company, wrongfully took control of various assets, manipulated financial records and more. She further accuses him of selling company property without providing accounting, obtaining Q Drum trademark registrations without her knowledge, manipulating tax filings, and more. She also claimed that Rubin and his associate Roger Ko improperly assumed control of funds generated via GoFundMe for Berman. You can read more over at Radaronline.com.

Both complaints in this suit remain pending in San Bernardino, CA Superior Court. In a since-delated statement July 2023 statement, Rubin claimed that he had the support of Berman‘s parents in shoring up the company’s business affairs in the wake of Berman‘s passing.
