Iced Earth’s Jon Schaffer To Remain In Custody Until Trial, Wishes He Could Have A “Do-Over” Regarding U.S. Capitol Building Riot


Iced Earth guitarist Jon Schaffer was in court via video teleconference today, March 19th. The 53-year-old musician was recently extradited from an Indiana jail to a detention facility in Washington, D.C., where he will face trial for his alleged involvement in the U.S. Capitol Building riot this past January.

Last week saw Schaffer‘s attorneys file this motion to have the several charges he is currently facing in connection to that riot dismissed. To that end they cited that the terms of The Speedy Trial Act had not been upheld. Passed into law in 1974, that act establishes that an individual must have information or an indictment filed within 30 days of being arrested or summoned.

With Schaffer having turned himself into authorities on January 17th, his legal team felt he had exceeded that window and thus should be released from custody, with the charges against him dismissed.

Today’s bail hearing ultimately saw U.S. Magistrate Judge Zia Faruqui refuse his request to be released from custody, ordering him to be held without bond until his eventual trial. As it stands, video footage and photographs find Schaffer to have been among those to have physically breached the U.S. Capitol Building this past January.

This ‘Statement Of Facts’ issued by the U.S. Justice Department in regards to Schaffer‘s charges allege that he attacked responding U.S. Capitol Police Officers with bear spray during the riot. It also notes that he had been wearing articles of clothing related to the ‘Oath Keepers’ militia during that event. Several members of that organization are currently facing charges for their participation in that riot. The ‘Oath Keepers‘ chapter in Schaffer‘s native Indiana however denied he was a member of their organization.

As it stands, Schaffer currently faces the following charges in relation to his activities on January 06th:

  • 1) Knowingly Entering or Remaining in any Restricted Building or Grounds Without Lawful Authority
  • 2) Disrupting the Orderly Conduct of Government Business
  • 3) Knowingly Engaging in an Act of Physical Violence Against any Person or Property in any Restricted Building or Grounds
  • 4) Violent Entry and Disorderly Conduct in a Capitol Building
  • 5) Engaging in an Act of Physical Violence in a Capitol Building
  • 6) Parading, Demonstrating, or Picketing in a Capitol Building

According to WUSA9, Schaffer‘s attorney argued in today’s hearing that his past comments made at a MAGA March held last November were taken out of context. They also report that Schaffer‘s attorney argued that his client knows he ‘used bad judgement’ on January 06th and wishes he could have a “do-over”.

Schaffer‘s attorney further argued that his client poses no danger to the community and has no prior record. Magistrate Judge Zia Faruqui disagreed however. While she concurred that he wasn’t a flight risk, she deemed Schaffer to be a potential threat to the community, ordering him to be held without bond until he faces trial.

Schaffer‘s comments made at the November rally which were mentioned in today’s hearing include:

“My name is Jon Schaffer. I’m from Indiana. A group of thugs and criminals hijacked this country a long time ago. Now they’re making their big move, and it’s not gonna happen. And that’s what it is. These are globalists. These are the scum of the earth. These are the criminals that are behind all the fraudulent fee on currency, they’re behind all the wars, they’re behind all the shit.

They’re behind divide-and-conquer tactics, behind the racial divide. It’s all nonsense, it’s all garbage. People need to wake up and snap out of the matrix, because they’re going down. They’ve made the move. They’re messing with the wrong people here—trust me on that. And we needed it to be open like this—open fraud, open theft. Because now we see you, and you’re going down. Mark my words.”

When asked whether or not he expected violence at that November event, he replied:

“If somebody wants to bring violence, I think there’s a lot of us here that are ready for it. We don’t want that, but if they bring it, we’re gonna respond to that—trust me.”

He later continued:

“I think this goes beyond President Trump. President Trump is a populist. He’s not your typical Republican. He’s not establishment. He’s not going out starting wars all over the place, like they do. Which is funny—where are all the Democrats that were anti-war? There’s so much hatred for Trump, it’s just ridiculous. He’s dealing with a criminal mafia that has been in the shadows running the world, frankly, for a very long time.

They wanna destroy all of our sovereignty and bring about global government. We’re not having it. We can still do business together, the countries can still be at peace, but we’re not gonna merge into some globalist, communist system. It will not happen. There will be a lot of blood shed, if it comes down to that—trust me. The American people will not go for that bullshit once they understand what’s actually happening. So, that’s where we’re at. Nobody wants this, but they’re pushing us to a point where we have no choice.”

Since word of his actions in the riot broke, several members have exited Iced Earth and Schaffer‘s Demons & Wizards project. Both bands also appear to have been scrubbed by their label, Century Media Records.
