Ex-Anthrax Singer Dan Nelson Arrested For Allegedly Assaulting Two Elderly Men


Dan Nelson, who notably fronted Anthrax from 2007 to 2009, was arrested on felony assault and harassment charges on August 31st. 2019 after allegedly assaulting two senior citizens following a performance at the Aloft Hotel in New York City.

The two alleged victims, James Paolino, 74, and Philip Falcone, 73, claim to have taken in Nelson‘s performance that night as one of their friends was filling in on drums for Nelson. Paolino told Daily News that Nelson appeared heavily intoxicated while onstage, stating of his condition: “He’s whacked. He can’t even tune his guitar. He had been drinking non-stop.”

Paolino says he and Falcone were in an elevator after the show with Nelson, when Paolino told Nelson “You had a rough night.” The comment allegedly sent Nelson into a rage, leading him to punch and kick Paolino. Falcone was also said to have been punched by Nelson after trying to verbally diffuse the attack.

Paolino told Daily News of the alleged assault:

“He started kicking me and punching me in the head. These were real MMA kicks. He knocked me down. I’m on the floor bleeding. He broke my glasses and I knew the next kicks were coming for my head. I’m helpless.”

“I’m still shaking. It was very traumatizing. He knocked my hearing aids out. This guy is an animal.”

The alleged assault reportedly came to an end when another person in the elevator physically attacked Nelson to get him to stop. Nelson is next due in court on the matter on October 11th. His lawyer Marc Isaac disputes the allegations, stating:

“I’ve seen the video, and what they’re saying is not correct. I can tell you that there was no bloody altercation. That’s completely false.”
