Gibson Files Suit Against Funko For Guitar Designs In Metallica, Guns N’ Roses, Etc. Toys


Gibson have filed suit against Funko over its usage of Gibson like guitars designs with their vinyl figures for various rock and metal icons. Law360 report that the guitar company filed suit against the company in a California federal court earlier this month. Funko has previously released figures in their successful Pop! Rocks line of various current & former Gibson using artists, including members of Metallica, Guns N’ Roses and Kiss.

The suit comes after Gibson claim to have unsuccesfully attempted to initiate a retroactive licensing deal for the usage of their guitar designs with the figures. As per their complaint, Gibson stated:

“The misuse of the Gibson trademarks by Funko was intended to cause, has caused, and is likely to continue to cause, consumer confusion, mistake or deception including the misleading of consumers into mistakenly believing that the defendant’s unauthorized products are made directly by Gibson pursuant to Gibson‘s strict quality control standards or Gibson has authorized or licensed the use by Funko of the Gibson trademarks for those products.”
