Father Of Late Gwar Frontman Dave Brockie Suing The Band For $1 Million (Updated)

Gwar have found themselves the target of a lawsuit filed by William Brockie, father of their late frontman, Dave “Oderus Urungus” Brockie. William is suing the band for $1 million in compensatory damages, punitive damages, and injunctive relief on claims of conversion, breach of contract, and unauthorized use of David Brockie‘s image, as well as the return of Brockie‘s cremated remains.

Courthousenews.com reports that William names Gwar drummer Brad “Jizmak Da Gusha” Roberts as the head of an alleged conspiracy regarding the usage and ownership of the likeness and property of his late son. He asserts that Roberts and the band made off with various guitars, artwork, personal effects, a gold record and more in the months following Dave‘s passing. He further states that the group have since locked the items away at their own Slave Pit Inc. headquarters

More troubling, William claims that when he went to said hq to retrieve the ashes of his son, he was forced to wait outside and given a “small fraction” of the ashes, in a “used plastic bag with a Discover credit card logo on it.”

William also alleges that the band tried to take control of his son’s estate from him, as well as setting up an unauthorized charity, the ‘Dave Brockie Fund‘, without his consent. In the suit, it is also alleged that that his consent was never given for Dave‘s likeness to be used at the 2014 ‘Gwar-B-Q‘ concert as well, which served as a viking funeral.

It is also stated that the releases granting the band usage of Brockie‘s likeness for future merchandising, etc. were signed and approved after his passing. Plus that money from a late 2014 tour was never received. The suit was filed in Richmond, VA this past Thursday, April 02nd. It is not yet clear if and when the case will proceed to court. Dave Brockie was found dead on March 24th, 2014, after suffering an accidental heroin overdose.
