While Between The Buried And Me themselves don’t appear to have commented on the matter, the group were rejoined onstage by their guitarist Dustie Waring during their set yesterday, September 24th, at the annual ‘Furnace Fest‘ in Birmingham, AL. Waring has since reposted several fan-filmed videos from the set on the stories section of his Instagram.
Waring had previously stepped down from the group back in May of this year, in light of a rape allegation made against him. The alleged incident was said to have taken place some five years prior, with Waring denying the allegation.
A follow-up statement was issued in June by Waring‘s lawyer Chad Diamond, Esq., labeling the allegations made against Waring as “malicious and false” and indicated that legal action was being pursued against the accuser. You can read that statement over at this location.

“Mr. Waring has always maintained his innocence regarding the false allegations against him. He has met those accusations head-on with the truth, and the facts speak for themselves. He has put this unfortunate situation behind him and is thrilled to finally get back to making music.”
