Josh Homme And Scott Reeder File Suit Against Kyuss Lives! Members Over Use Of Kyuss Name

Former Kyuss members Joshua Homme (Queens Of The Stone Age, etc.) and Scott Reeder have filed a federal lawsuit against their ex-Kyuss bandmates John Garcia and Brant Bjork over the use of the Kyuss name. The following statement was issued by the Homme and Reeder:

Kyuss members Scott Reeder and Joshua Homme have been forced to file a federal lawsuit against John Garcia and Brant Bjork a/k/a Kyuss Lives! The suit alleges trademark infringement and consumer fraud by Kyuss Lives!

Quote from Reeder and Homme is below.

“It sucks. To think we went to a meeting in January solely to help them with their request to continue Kyuss Lives! With open arms, we made every attempt to help them continue Kyuss Lives! respectfully. Only to discover while they looked us in the eye, Kyuss Lives! management and band had filed federal documents in 2011 in an attempt to steal the name Kyuss.

This is desperately what we were trying to avoid. It’s a sad day for us and for John – but most of all for the fans. What a needless mess.”

    Seriously, Homme? Last time I checked you make loads of cash from your many musical endeavors (mostly Queens) yet you find it necessary to sue your broke ass former bandmates? Dude, Reeder even toured Europe as bassist for Kyuss Lives! what’s his deal? Homme is a fucking rat.

        Hey idiot, that was a shitty example. Hagar never owned the rights to the VH name nor was he even an original member. Besides, if you knew anything about VH you would know that Eddie and Alex have held the rights to the name from day one.

        You also obviously dont know shit about Kyuss either. John Garcia and Brant Bjork are original founding members of Kyuss. It’s been 17 years since Homme and Garcia’s bullshit and apparently Homme cant get over it.

        point is, josh wrote the majority of the songs, was always a member (lets not forget brant dipped 2 years before they broke up), and is basically synonymous with the name kyuss (i guarantee the average music fan cannot name anyone else in the band). its not kyuss without him.

        that’s pretty stupid logic. so because Homme made it big in a band after Kyuss, and the average music fan recognizes his name over Garcia’s, he is entitled to sue these guys for carrying on with a different name but playing the old tunes?

        you’re average music fan won’t know Kyuss. if they do, changes are they will know the members’ names. your casual QOTSA fan wont even know Homme was part of Kyuss. So you’re final point makes no sense.

    I thought the “Sons of Kyuss” was owned by the Dungeons and Dragons publisher.

    If they got away with “Kyuss” then “Kyuss Lives” should be just fine on it’s own.

    They did add “Lives” to point out it’s a different band. Homme needs to chill and let it go.

    If Homme and Reeder want in on the cash, then they had better make nice and lay down some quirky heavy riffs.

    If I had to choose between Kyuss Lives and Queens of the Stone Age, Kyuss Lives would win every time.

        Oh, I think I misunderstood the article. I thought Homme was suddenly taking away the name Kyuss, I didn’t make the connection that they just wanted to drop the “Lives” part of the name.

        Homme has repeatedly said Kyuss is dead; that’s going to hurt his chances of having a share of the trademark.

        He should just jump on board, record and tour with them.

        Bjork and Garcia are the 1% here as far as wealth is concerned. They’re the ones that need our support. Desert Punks all the way!

        Homme needs to come to terms with his Punk Rock Guilt.
